These Terms and Conditions ("Terms") apply to the websites TokyoCentral.com, Marukai.com, MarukaiCorp.com, and smartsavercard.tokyocentral.com (each a "Website" and collectively, the "Websites"), which are operated by Marukai Corporation dba Tokyo Central ("Tokyo Central," "we," "us," or "our").

1. Eligibility

You must be at least 13 years of age to use the Websites. By using the Websites, you represent that you are of legal age to enter into these Terms, or, if you are not, that you have obtained parental or guardian consent and your parent or guardian agrees to these Terms on your behalf.

2. Overview and Acceptance

PLEASE READ THESE TERMS CAREFULLY. By accessing or using any part of the Websites, you agree to be bound by these Terms and all applicable federal, state, and local laws. If you do not agree, please do not use the Websites.

3. Privacy Policy (including CCPA Notice)

Your use of the Websites is also subject to our Privacy Policy, which is incorporated by reference. The Privacy Policy describes how we collect, use, and disclose Personal Information, including information collected through the Smart Saver Card program.

4. Intellectual Property

All content on the Websites ("Materials") is owned by or licensed to Marukai Corporation and protected by U.S. and international intellectual property laws. You may access Materials solely for personal, non-commercial use. Any other use is prohibited without written authorization.

5. Warranty Disclaimer

The Websites and all materials are provided "as is" and "as available" without warranties of any kind. We disclaim all implied warranties to the fullest extent permitted by law.

6. Limitation of Liability

To the maximum extent permitted by law, Tokyo Central shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Websites.

7. Online Store, Products, and Availability

TokyoCentral.com operates an online store hosted by Shopify Inc.. We reserve the right to limit, refuse, modify, or discontinue products, services, pricing, or features at any time.

8. Accuracy of Information

Information on the Websites may contain errors or omissions. We reserve the right to correct or update information at any time without notice.

9. Billing and Account Information

You agree to provide accurate and complete account and payment information and to keep such information up to date.

10. Refund Policy

Returns, refunds, and cancellations are governed by our Refund Policy, which is incorporated by reference.

11. Optional Tools

We may provide access to third-party tools "as is" and without warranties. Your use of such tools is at your own risk.

12. Third-Party Links

Links to third-party websites are provided for convenience only. We are not responsible for third-party content or practices.

13. User Feedback and Submissions

These Terms are governed by the laws of the State of California. Venue for disputes shall be Los Angeles County, California.

You agree to indemnify and hold harmless Tokyo Central from claims arising from your use of the Websites or violation of these Terms.

We may terminate or suspend access to the Websites at any time for violations of these Terms.

18. Entire Agreement

These Terms constitute the entire agreement between you and Tokyo Central regarding use of the Websites.

Tokyo Central is committed to providing a website accessible to the widest possible audience. We continually improve accessibility and usability.

20. Smart Saver Card Program

A. Program Description

The Smart Saver Card is a free loyalty program offering exclusive discounts, promotional offers, and member-only benefits at all Tokyo Central and Marukai locations. The program is operated by Marukai Corporation dba Tokyo Central.

B. Eligibility

To register for a Smart Saver Card, you must be at least 13 years of age and provide a valid email address. Membership is limited to one account per person. Duplicate accounts may be merged or deactivated at our discretion.

C. Registration

Members may register online at smartsavercard.tokyocentral.com or in-store at any Tokyo Central or Marukai location. During registration, the following information is collected:

  • Required: First name, email address, preferred store location.
  • Optional: Last name, phone number, zip code, birth date (month/day/year).

You agree to provide accurate and truthful information during registration and to keep your information up to date.

D. Account Activation

After registration, an activation email is sent to your registered email address. You must click the activation link in the email to activate your account and access member benefits. Accounts that are not activated within 30 days of registration may be automatically deactivated and removed.

E. Digital Card

Upon activation, members receive a digital Smart Saver Card with a unique barcode. The digital card can be accessed online through the card lookup flow, downloaded as a PNG image, or saved as a PDF. The barcode must be presented (on screen or printed) at checkout to receive member pricing and promotional discounts.

F. Identity Verification (OTP)

When looking up your card online, we verify your identity by sending a one-time password (OTP) to your registered email address. OTP codes are 6 digits and expire after 2 minutes. This verification step is required for the security and privacy protection of all members. We do not display member names or email addresses on the card lookup results without successful OTP verification.

G. Email Communications

By registering for a Smart Saver Card, you consent to receiving the following email communications:

  • Transactional emails (required for program operation): Account activation, one-time verification codes (OTP), account confirmation, and digital card delivery. These are service communications and cannot be opted out of while your account is active.
  • Promotional emails: Exclusive offers, discounts, events, and savings opportunities available to Smart Saver Card members. You may opt out of promotional emails at any time (see Section 21).

H. Member Conduct

As a Smart Saver Card member, you agree to the following:

  • You will not share, duplicate, sell, or transfer your Smart Saver Card or barcode to another person.
  • You will not use another person's Smart Saver Card or barcode.
  • You will not create multiple accounts to obtain additional benefits.
  • You will not attempt to manipulate, exploit, or abuse the program or its promotions.

Violation of these rules may result in immediate account termination and forfeiture of any pending benefits.

I. Program Changes

Tokyo Central reserves the right to modify, suspend, or discontinue the Smart Saver Card program, in whole or in part, at any time with or without notice. This includes changes to benefits, discounts, promotional offers, eligibility requirements, and these program terms. Continued use of the program after changes constitutes acceptance of the updated terms.

J. Account Termination

We may terminate or suspend a member's account at any time for:

  • Violation of these Terms or program rules;
  • Suspected fraud or program abuse;
  • Providing false or misleading registration information;
  • Any other reason at our sole discretion.

Members may voluntarily deactivate their account at any time by contacting us at info@marukai.com. Upon deactivation, member benefits will cease and the digital card will no longer be accessible. Data retention after deactivation is governed by our Privacy Policy.

21. Email and Electronic Communications

By providing your email address to Tokyo Central — whether through a purchase, account registration, or Smart Saver Card enrollment — you consent to receive electronic communications from us.

A. Transactional Emails

Transactional emails include order confirmations, shipping notifications, account activation emails, one-time verification codes (OTP), digital card delivery, and account status notifications. These are service communications necessary to fulfill your requests and operate your account. Transactional emails are not subject to marketing opt-out preferences.

B. Marketing and Promotional Emails

Marketing emails include promotional offers, member-exclusive discounts, event announcements, and other commercial communications. All marketing emails comply with the CAN-SPAM Act and include:

  • Accurate sender identification ("From" Tokyo Central);
  • Truthful subject lines that reflect the content of the message;
  • A clear and conspicuous Unsubscribe link in every email;
  • Our physical mailing address: Marukai Corporation, 1740 Artesia Blvd, Gardena, CA 90248.

C. Opt-Out

You may opt out of marketing emails at any time by:

  • Clicking the "Unsubscribe" link at the bottom of any marketing email; or
  • Contacting us at info@marukai.com with the subject line "Unsubscribe."

We will honor all opt-out requests within 10 business days. Opting out of marketing emails will not affect your receipt of transactional emails, your Smart Saver Card membership, or your access to in-store benefits.
